The changes underlined (section (b)(2)) will exempt corporations like LegalZoom from the practice of law.

The fact that one needs to use a licensed attorney in North Carolina to assist in deeds, wills, complaints and more for others, is there to protect the public. Quite honestly, the more people use Legalzoom or draft Wills, deeds, and POAs for family members or others without the help of attorneys, the more attorneys get compensated because of litigation involved in the mistakes created.

Here are the proposed changes (underlined):

G.S. 84-2.1 reads as rewritten:

“§ 84-2.1. “Practice law” defined.

(a) The phrase “practice law” as used in this Chapter is defined to be performing any

legal service for any other person, firm or corporation, with or without compensation,

specifically including the preparation or aiding in the preparation of deeds, mortgages, wills,

trust instruments, inventories, accounts or reports of guardians, trustees, administrators or

executors, or preparing or aiding in the preparation of any petitions or orders in any probate or

court proceeding; abstracting or passing upon titles, the preparation and filing of petitions for use in any court, including administrative tribunals and other judicial or quasi-judicial bodies, or assisting by advice, counsel, or otherwise in any legal work; and to advise or give opinion upon the legal rights of any person, firm or corporation: Provided, that the above reference to

particular acts which are specifically included within the definition of the phrase “practice law”

shall not be construed to limit the foregoing general definition of the term, but shall be construed

to include the foregoing particular acts, as well as all other acts within the general definition.

(b) The phrase “practice law” does not encompass any of the following:

(1) the drafting or writing of memoranda of understanding or other mediation

summaries by mediators at community mediation centers authorized by

G.S. 7A-38.5 or by mediators of employment-related matters for The

University of North Carolina or a constituent institution, or for an agency,

commission, or board of the State of North Carolina.

(2) the design, creation, assembly, completion, publication, distribution, display,

or sale, including by means of an Internet Web site, of self-help legal written

materials, books, documents, templates, forms, computer software, or similar

products if the products clearly and conspicuously state that the products are

not a substitute for the advice of an attorney. ”

Redevelopment started on old Forsyth County Courthouse–downtown apartments

Construction has begun on the old Forsyth County Courthouse in Winston-Salem. The developer, Clachan Properties, LLC out of Richmond VA, plans to put in 57 apartments. Most will be single bedroom, but some will be two bedrooms. Clachan is investing $6m in the construction. Demolition has begun in earnest (see the photograph above).

In April of ‘14, Clachan Properties began demolition on an $11 million, 86-apartment project, redeveloping a former R.J. Reynolds Tobacco Co. building at 101 Sixth St. This is the second phase of Winston Factory Lofts, an apartment building that Clachan developed in the downtown area.

The owner of Clachan, Herb Coleman, is a big fan of Winston-Salem even though he lives in Richmond.

His company has developed several other historic buildings in town.

If you haven’t driven downtown Winston-Salem in a while, make sure to go east of the Reynolds building & Winston Tower. There’s a lot of development occurring in the Innovation Quarter. It’s worth the drive and is exciting for our City’s future.

Reynolds Building to be sold- transformed into Apartments & Hotel

The Reynolds Building in downtown Winston-Salem is being sold to a partnership between Kimpton Hotel & Restaurant Group LLC of San Francisco CA and PMC Property Group of Philadelphia, PA.

The owners plan to purchase the 314,000-sq ft Reynolds Building from Reynolds American Inc. (NYSE: RAI)

Plans are to and convert it into a boutique hotel and apartments.

The building has exquisite art deco interior in the main lobby.

Posting Land for Hunting in NC

If you own land & want to post it so no one else hunts, fishes, or traps on your land, here are two pertinent links.

One is to the North Carolina Wildlife regulations. It’s a very informative document.

The next link is to the NC Statutes regarding posting your property.

The key is to post the sign no less than every 200 yards along the property line. Plus, post every side of the property and every corner.

If posting with a sign, the sign needs to be at least 120 square inches.

Note: the new rules also permit the property to be marked with PURPLE paint. The stripe of paint needs to be 8” long, painted vertically. The paint stripe needs to be painted between 3’ and 5’ from the ground.

Remember: if you let someone use the land, they’ll need WRITTEN permission signed by one of the owners. In that form, add language that they release the owners from liability for injuries.

You should also strongly consider having some insurance on the property for anyone injured.
